Selectboard Meeting Minutes – April 17, 2018




APRIL 17, 2018

 BOARD MEMBERS PRESENT:    Marion Dowling, Gary Delius, Mike Fitzpatrick, Shelly Huber, Christopher Williams

OTHERS PRESENT:    Jay Wilson, Shannon Meckle, Ed Druke, Jr.


The meeting was called to order at 6:00 p.m. by Marion Dowling, Chair.


 There were no additions or amendments to the agenda.


April 2, 2018 Regular Meeting (with Board of Liquor Control & Board of Health):     A motion was made by Mike Fitzpatrick and seconded by Christopher Williams to approve the minutes. The motion carried unanimously.

April 9, 2018 Special Meeting: A motion was made by Christopher Williams and seconded by Shelly Huber to approve the minutes. The motion carried with four in favor and Gary Delius abstaining.


Road Foreman’s Report: See attached report.

 A motion was made by Mike Fitzpatrick and seconded by Shelly Huber to accept the report. The motion carried unanimously.

Truck Bids:  Jay went over the two truck bids, noting that the Mack with trade-in and warranty came in at $171,038. Western Star with trade in and warranty came in at $161,404, a difference of $8,734.00. Jay noted that Mack included buy back figures of $52,000 at 7 years and $38,109 at 10 years. It was Jay’s opinion that Mack, with the buy back figure, is the cheaper choice because of the value.

Discussion ensued regarding the merits of each truck. Mike recommended getting a buy back value from Western Star and reviewing the bids before the next meeting.

A motion was made by Gary Delius to table until April 23, 2018 at 6:00 p.m. The motion was seconded by Shelly Huber.

Gary asked for it to be on record that the town should be taking the lowest qualified bid.

The motion carried unanimously.

Excavator Bids:

 The Board reviewed the excavator bids. Discussion ensued regarding purchasing vs. leasing. The Board would be interested in a demo model.

A motion to approve as corrected the Town Of Newfane Invitation to Bid for Lease or Purchase Wheeled Excavator and Attachments. The motion was seconded by Shelly Huber. The motion carried unanimously.

 A motion was made by Shelly Huber and seconded by Gary Delius to approve the closing of West Street for the Morris Dancers on May 27.  The motion carried unanimously.

 A motion was made by Shelly Huber and seconded by Mike Fitzpatrick to approve the design of the Brookside sign.  Discussion – Gary confirmed with Shannon that the residents have seen and approved of the sign.  Shelly confirmed with Jay Wilson that new sign posts would be installed.  The motion carried unanimously.

 A motion was made by Gary Delius and seconded by Mike Fitzpatrick to accept the Administrative Assistant’s Report. The motion carried unanimously.


There were no Unscheduled Members of the Public.


Land Sale – W.W. Building Supply:  The Board reviewed the Purchase and Sales Agreement.  Shannon noted that Rich Carroll had not made comments on the agreement yet.  A motion was made by Gary Delius and seconded by Christopher Williams to table signing the Purchase and Sales Agreement until the special meeting on April 23, 2018, pending attorney approval. The motion carried unanimously.

Shannon noted that the survey or a drawing was necessary to submit the subdivision permit.

A motion was made to appoint Marion Dowling as agent for this transaction. The motion was seconded by Christopher Williams. The motion carried unanimously.

 Manitou Land Donation Offer:  Shannon read the letter received by Mike Mayer. The Board clarified that there was no action needing to be taken.


Windham Regional Commission Agreement:  Shannon presented the agreement between Windham Regional Commission and the Town of Newfane for assistance in revising the Town Plan.  Shannon noted that it was voted on at the last meeting, however the contract didn’t get signed. Marion signed the agreement.

Williamsville Traffic Issue:  Discussion ensued regarding traffic and speeding in Williamsville. Christopher noted that parking has become an issue on Timson Hill Road and recommended a “No Parking” sign.


A motion was made by Gary Delius and seconded by Mike Fitzpatrick to approve pay orders as follows:

 Accounts Payable Warrant No. 18022 in the amount of $47,592.39

  • Accounts Payable Warrant No. 1822A in the amount of $30,258.64
  • Payroll Warrant No. 11335 in the amount of $4,953.63
  • Payroll Warrant No. 11336 in the amount of $3,857.64

 The motion carried unanimously.


A motion was made by Gary Delius and seconded by Shelly Huber to adjourn at 7:45 p.m. The motion carried unanimously.

  1. The Williamsville Hall well was redone and a new pump installed (you should have the bill in your pay orders). We have some top soil work and seeding to do once the weather is nicer.  We replaced a circulator for the kitchen zone and will have at some point a recommendation on additional repairs on the heating system.


  1. The furnace at the garage was cleaned and brought up to code. The original building wiring was corrected so now the Firematic and the emergency switch both work. The oil line was changed and stainless flex line was added to the burner for easier cleaning.


  1. I took the insurance inspector through the town buildings on Monday, so it was good that the furnace at the garage had been serviced.


  1. The Ford F550 had to be towed today to Faith Ford for an emission problem, I would suspect it will be under warranty but we have to cover the towing.


  1. The wind storm a couple of weeks ago caused significant damage, I would estimate between labor and equipment it cost between $5,000 and $6,000 to clean up the trees.

BROOKSIDE SIGN:  The 50% deposit has been paid.  Attached, please find the sample. Note that the font is close to what he’ll be using, but not exact, as he hand letters the signs and the computer doesn’t have the exact same font. He also sent an answer regarding weatherproofing. That’s also attached.

FEMA: Jay and I attended a conference call with FEMA this afternoon, which introduced us to our Public Assistance contact person.  They gave us a list of documentation they will need and we’ll be meeting with them in person to go over my files in May.

MORRIS DANCERS: The Morris Dancers are looking for permission to close a portion of West Street on May 27, 2018 between 4:00 and 7:00 p.m. for their annual dance.  They will also be contacting the Sheriff’s Department for coverage.

TIME OFF: I’ll be taking vacation time for the rest of this week but will post the minutes on the website before I go to meet the 5-day deadline.
