CALL TO ORDER
The meeting was called to order at 5:30 p.m. by Carol Hatcher, Chair.
ADDITIONS/AMENDMENTS TO THE AGENDA
A motion was made by Gary Delius and seconded by Marion Dowling to table the Administrative Assistant’s report until October 2 and to move “Road Foreman Vacancy” to Road Business. The motion carried unanimously.
EXECUTIVE SESSION – PERSONNEL
A motion was made by Gary Delius and seconded by Marion Dowling to enter into Executive Session for the discussing the appointment or employment of a public officer or employee pursuant to 1 VSA §313(a)(3). The motion carried unanimously and the Board entered into Executive Session at 5:35 p.m.
A motion was by Gary Delius and seconded by Mike Fitzpatrick to come out of Executive Session at 6:54 p.m. The motion carried unanimously.
Gary Delius made a motion that after 35 years of service, the Board pay Todd Lawley for all accrued leave time, above and beyond the Personnel Policy allowances in order to tide him over until retirement comes in; and in addition to pay for one full month of COBRA insurance coverage. Marion Dowling seconded the motion. The motion carried unanimously.
Marion Dowling made a motion to enter into negotiations with Jay Wilson to assume the role of Road Foreman of the Town of Newfane. The motion was seconded by Mike Fitzpatrick. The motion carried unanimously.
August 28, 2017: The minutes were reviewed. A motion was made by Mike Fitzpatrick to approve the minutes. The motion was seconded by Gary Delius. The motion carried unanimously.
September 11, 2017: The minutes were reviewed. A motion was made by Gary Delius and seconded by Mike Fitzpatrick to approve the minutes. The motion carried unanimously.
Road Foreman’s Report: See attached report.
Road Foreman Vacancy: Carol Hatcher read Todd Lawley’s letter of resignation. The Board thanked Todd for his service.
SCHEDULED MEMBERS OF THE PUBLIC
Ed Druke, WW Building: Ed was present to discuss his plans for expanding and improving his business. He noted his intention is still to do something with the town, such as a property swap and that he does have a contract signed on the property next door.
The Board requested a more specific plan in writing so that they can further explore the logistics of the idea. To show their willingness to explore the idea, a motion was made by Gary Delius and seconded by Mike Fitzpatrick to request detailed information in writing from Ed, with plans so that the Board can begin to discuss it and enter into negotiations based on typical hearing requirements. The motion carried unanimously.
Daniels Hill Road Association: Pete Novick was present to discuss his request letter. He presented history of the road. The letter requested that the town take on the laying out process of its own motion.
A lengthy discussion ensued regarding the laying out process and the condition and location of the road.
A motion was made by Mike Fitzpatrick and seconded by Gary Delius to require a petition signed by Newfane voters and landowners, equal in number to 5% of the registered voters.
Further discussion ensued regarding the process.
Gary called the question. The motion to call the question passed unanimously.
The motion to require a petition also carried unanimously.
UNSCHEDULED MEMBERS OF THE PUBLIC
Ken Estey announced that the Open and Accepting Committee would meet next Monday at 6:00. A special guest, Karen Richards, Executive Director of the Vermont Human Rights Commission would be attending. Ken extended a special invitation to the Selectboard and noted it was open to all.
Personnel Evaluations: The Board discussed the Personnel Evaluations schedule. Shannon and Marion will do Merle’s evaluation. Gary and Marion will do Shannon’s evaluation.
Job Description Updates: The Board re-signed the Highway Crew Job Description with no changes. The Board reviewed the Road Foreman’s Job Description. A motion was made by Gary Delius and seconded by Marion Dowling to approve the Road Foreman’s Job Description. The motion carried unanimously.
Salary, Road Foreman: A motion was made to authorize by Mike Fitzpatrick to Carol Hatcher to hire Jay at no more than $20.50 per hour with an increase after a successful six month review. The motion was seconded by Gary Delius. The motion carried unanimously.
Salary, Road Crew Member: A motion was made by Mike Fitzpatrick to increase Steve Languerand’s pay to $20.00 per hour. The motion was seconded by Gary Delius. The motion carried unanimously.
- A letter was received from Tim and Karen Cawrse requesting a site visit regarding drainage issues on Stratton Hill Road. Mike and Christopher will look and report at the next meeting.
- A letter was received from Thom Dahlin regarding the end of the pavement on South Wardsboro Road and also regarding the painting of the town office. Marion will get back to him.
- A letter was received from South Newfane/Williamsville Fire Department confirming that they are in the process of closing the fire department.
- A letter was received from the Town of Brookline regarding Newfane residents using Brookline recycling bins. Shannon will respond.
A motion was made by Gary Delius and seconded by Chris Williams to approve the pay orders as follows:
- Accounts Payable Warrant No. 18006 in the amount of $858,513.87
- Accounts Payable Warrant No. 18005 in the amount of $39,667.61
- Payroll Warrant No. 09/13/17 in the amount of $3,872.70
- Payroll Warrant No.09/06/17 in the amount of $6,989.37
The motion carried unanimously.
A motion was made by Mike Fitzpatrick and seconded by Marion Dowling to adjourn at 8:55 p.m.
ROAD FOREMAN’S REPORT
Roads: The roads are doing better without the heavy downpours. The crew is getting them shaped up with the grader and backhoe. The crew is getting some ditch work done, along with brush cutting around the band rail and intersections.
Equipment: The 09 Sterling is back from being repaired. There is still something wrong, as it is constantly going into a “regen mode.” When budget time comes, the Board should consider replacing that truck.
New Truck: The new pick up should be at Summit any time. Todd will check in on the status.
River Road Bridge: Daniels Construction reports that they will be closing the road at the end of this month until mid-November. The contractor is supposed to notify the residents and the media, as well as take care of signage.
Drainage Issues: Several letters have gone out to landowners regarding drainage causing damage to roads.
White Line Striping: The company who did the line striping last year is months behind and would not be able to come to Newfane until mid-November. Todd will work on finding another company. The yellow lines are in process.
