To be noted: only Brad and Pamela Horn, owners of Newfane Redevelopment Corp, and Marie Peroni were notified of the hearing as others did not have a current address; neither party attended the hearing.
Priscilla Cotton, Chair, brought the meeting to order at 5:38 p.m.
Maureen Albert-Piascik asked to add Dan and Mary Gleason, Parcel ID# 00B147.KA9 to the list (as included in the revised copy of the Treasurer’s List that the board members received).
Initiated by Maureen was a brief discussion of the propriety of her voting in the process since she was presenting as Collector of Delinquent Taxes. It was the general consensus that she could vote.
Each member of the Board of Abatement received a copy of the warning that had been sent to them, and the Treasurer’s List of mainly Kenolie Village taxpayers. The overriding reason for the abatement of these Kenolie Village taxpayers’ taxes was that the taxpayers were no longer at Kenolie Village, and Maureen did not have a current address. The only exception to this was Joyce Ewens, Parcel ID# 00B253; at the sale of her property in 2012, an error occurred in the closing and the taxes were never collected, and Maureen has no current address. Gloria thanked Doris Knechtel for her work in breaking down the tax information from the information that the Treasurer provided. Gloria Cristelli moved to abate the taxes, interest, and penalties for a total of $6.401.95. Ellen Darrow seconded the motion. The motion passed unanimously.
Doris Knechtel provided the board members with the abatement list from the Listers.The list had four (4) parcels as well as the Tax Abatement formfor the Newfane Development Corp. On March 2, 2016 the business property owned by Brad and Pamela Horn burned to the ground. Doris discussed the calculations she used to arrive at the figure of $1,236.49 to be abated for the Newfane Development Corp. Mary Ann Clarkson moved to abate $1,236.49 for Parcel ID 00B056. Gloria Cristelli seconded the motion. The motion passed unanimously.
Doris Knechtel explained the taxes on Parcel ID# 00F051 now owned by the Town of Newfane and previously owned by James Furnell, Scottish national. The FEMA buyout of that property was late in being processed because the Furnells were not U.S. citizens. Carol Hatcher moved to abate the taxes, interest, and penalty in the amount of $544.76. Gloria Cristelli seconded the motion. The motion passed unanimously.
Parcel #00B147.KAO, owned by Sharon Walczak, was on the Listers’ List and the same reasoning as all of the other Kenolie Village taxpayers applied to this parcel. Mary Ann Clarkson moved that the taxes, interest, and penalty in the amount of $99.41 be abated. Maureen Albert-Piascik seconded the motion. The motion passed unanimously.
Doris Knechtel presented information on Marie Peroni’s Parcel ID# 00F063. The property located on Dover Road has been uninhabitable since Tropical Storm Irene. Shannon Meckle, administrative assistant to the Selectboard who has overseen the pending buyout of the property through a Hazardous Mitigation Block Grant (HMBG) read her letter explaining the series of unfortunate events that occurred in the last four plus years. A copy of the letter is on file in the Town Clerk’s Office. Basically, town, state, and federal turnover of personnel caused Peroni’s application to be dropped through the cracks. Mrs. Peroni is unable to pay the taxes. Her request for tax abatement is a unique situation caused by the flooding and length of time for her property to be bought out. Maureen Albert-Piascik stated that she, as Collector of Delinquent Taxes, had already eliminated her penalty from the equation. Mary Ann Clarkson moved to abate the taxes and interest in the amount of $5,921.12. Ellen Darrow seconded the motion. After considerable discussion, Gloria Cristelli moved the question. A two-third’s majority approved by hand vote to vote on the motion. The motion passed unanimously.
Board of Abatement members signed both the Treasurer’s List and the Listers’ List for the abatement of taxes.
Gary Delius moved to adjourn, and Maureen Albert-Piascik seconded the motion. The hearing adjourned at 6:05 p.m.
